This is the most specific project-level issue in the review, and buffer violations have had serious consequences for completed buildings in Bengaluru.

  2. Is the latest Encumbrance Certificate available?

    The RTCs and ECs examined did not reveal encumbrances against the schedule property, but an EC is a point-in-time record and should be refreshed before you transact.

    What to ask: Can you provide the latest Encumbrance Certificate covering the relevant property records?

  3. Are the original title documents available for verification?

    A review of copies is not a substitute for sighting originals. Verification of the original documents was identified as an important step.

    What to ask: Can the original title documents, registered JDAs, GPAs and related documents be made available for verification?

  4. What is the status of the Occupancy Certificate?

    The Occupancy Certificate is obtained after construction and confirms the completed building matches the approved plan. It affects lending, resale and lawful occupation.

    What to ask: What is the current status of the Occupancy Certificate, and when is the final OC expected?

  5. Which outstanding documents are still pending?

    The review identifies further items to procure or verify, including e-Khata, tax paid receipts, an updated EC, a non-litigation affidavit and loan documents where applicable. Some relate to the individual apartment rather than the project as a whole.

Based on the documents reviewed, Prestige Lavender Fields has a documented title and development structure, with ownership and development rights traced through registered sale deeds, JDAs and GPAs covering 2020 to 2023, and a substantial set of statutory approvals and NOCs on file. The RTCs and ECs examined did not reveal encumbrances against the schedule property. Several items still require verification before you transact: an updated EC, sighting of the original documents, the Occupancy Certificate position, the outstanding unit-level documentation, and — most specifically — the NALA that passes through the project. The documents themselves recommend confirming that its buffer zone has been released as per the plan, and that is the one item we would not proceed without seeing in writing.
